NSW Government Civil Litigation Consultation Paper

As part of its commitment to respond to the recommendations of the Royal Commission into Institutional Responses to Child Sexual Abuse, the NSW Government is considering legislative reforms to expand the civil liability of institutions for child abuse, and to remove barriers faced by survivors when pursuing civil claims for compensation in NSW.

The Department of Justice has prepared a Consultation Paper which outlines the context for the Royal Commission’s recommendations, identifies key issues and poses a number of questions for consideration.

The Department of Justice invites interested individuals and organisations to provide written submissions in response to any of the issues raised. The NSW Government will also use the paper as a framework to guide face-to-face discussions with certain stakeholders.

The paper is now available on the Have Your Say website and the Department of Justice website.

There are two fact sheets available – The Duty of Institutions and Identifying a Defendant – to provide an overview of the Consultation Paper.
